Bucharest Court Halts PNL Extraordinary Congress Resolutions amid Legal Disputes

The challengers of Ilie Bolojan have achieved a significant legal victory with the Bucharest Tribunal’s decision to provisionally suspend the resolutions passed during the PNL’s Extraordinary Congress on June 21, 2026. This includes halting the election of the new PNL leadership and the adoption of the party’s revised Statute.

During the second hearing, the judges from the Third Civil Section ruled as follows:

  • Accepted the request.
  • Summary decision: Accepted the objection regarding the lack of passive procedural capacity for defendants Ilie-Gavril Bolojan, the President of the National Liberal Party, and Dan-Ștefan Motreanu, the Secretary General of the National Liberal Party, as raised by the defendant National Liberal Party.
  • Rejected the claim against Ilie-Gavril Bolojan and Dan-Ștefan Motreanu, considering them improperly named as defendants.
  • Dismissed the objections of prematurity and inadmissibility put forward by the defendant as unfounded.
  • Approved the lawsuit filed by the claimants against the defendant National Liberal Party, as specified.
  • Provisionally suspended the enforcement and effects of the following resolutions until the final resolution of case no. 26120/3/2026, pending before the Fifth Civil Section of the Bucharest Tribunal:
  • 1. Resolution no. 01/2026 of the PNL Extraordinary Congress dated 21.06.2026;
  • 2. Resolution no. 02/2026 of the same Congress;
  • 3. The resolution approving the election of the PNL leadership following the “Modernization with Roots” motion, as recorded in the Congress proceedings on 21.06.2026;
  • 4. The resolution approving amendments to the PNL Statute, as adopted by the National Extraordinary Council’s resolution no. 02/2026 dated 19.06.2026, including subsequent acts:
  • 5. Decision no. 01/21.06.2026 of the National Standing Bureau;
  • 6. Decision no. 02/21.06.2026 of the National Standing Bureau;
  • 7. Decision no. 03/21.06.2026 of the National Standing Bureau;
  • 8. Decision no. 04/23.06.2026 of the National Standing Bureau;
  • 9. Decision no. 05/23.06.2026 of the National Standing Bureau;
  • 10. Decision no. 06/23.06.2026 of the National Standing Bureau;
  • 11. Decision no. 07/23.06.2026 of the National Standing Bureau;
  • 12. Decision no. 08/23.06.2026 of the National Standing Bureau;
  • 13. Decision no. 09/23.06.2026 of the National Standing Bureau;
  • 14. Decision no. 10/23.06.2026 of the National Standing Bureau;
  • 15. Decision no. 11/23.06.2026 of the National Standing Bureau;
  • 16. Decision no. 12/23.06.2026 of the National Standing Bureau;
  • 17. Decision no. 13/23.06.2026 of the National Standing Bureau;
  • Enforceable by law. The defendant reserves the right to seek legal costs in a separate proceeding.
  • The decision is subject to appeal within 5 days of issuance. Appeals should be filed with the Third Civil Section of the Bucharest Tribunal. Delivered on 08.07.2026, made available to the parties via the court registry.

The claimants include Monica Anisie, Andrei Baciu, Lucian Bode, Rareș Bogdan, Sorin Câmpeanu, Alina Gorghiu, Ion Iordache, Aneta Matei, Ciprian Pandea, Nicoleta Pauliuc, Sorin Prișcă, Rusu Sebastian, George Scarlat, Dragoș Soare, Ionuț Stroe, Thuma Hubert, Adrian Veștea, and Mihail Veștea.

The defendants named in the case are the PNL through Ilie Bolojan, Ilie Bolojan himself, and Dan Motreanu. The court also rejected a recusal request filed by Bolojan’s legal representative, Valeriu Stoica, against the judges involved in the case.

July 1, 2026: Bucharest Tribunal Suspends PNL National Council Resolution

Ilie Bolojan, the PNL President, has consistently faced legal setbacks in all disputes brought against him by his challengers.

  • Provisional suspension of the enforcement and effects of the PNL National Extraordinary Council’s resolution no. 01/2026 dated 19.06.2026, pending final case resolution no. 26127/3/2026 at the Fifth Civil Section of the Bucharest Tribunal.

According to sources, subsequent acts, including the organization and proceedings of the PNL Congress on June 21, 2026, might also be annulled.

The legal efforts of Bolojan’s challengers were supported by lawyers Roxana Tudose and Claudia Cliza at that time.

Four Legal Challenges Against Bolojan

The following legal actions were initiated at the Bucharest Tribunal:

  • Annulling the resolution of the PNL Extraordinary Congress no. 01/2026 from June 21, 2026, instituting “automatic” exclusion of members voting for or forming a government with PSD outside the established political line.
  • Challenging the PNL Extraordinary Congress resolution no. 02/2026 from June 21, 2026, demanding resignations of several members and mandating exclusion procedures.
  • Seeking annulment of the leadership election through the “Modernization with Roots” motion (President, First Vice-President, Secretary General, and eight Vice-Presidents).
  • Requesting annulment of the ratification of amendments to the PNL Statute.

The challengers requested the annulment of all subsequent acts based on these contested resolutions, citing legality issues such as:

  • The resolutions were based on a draft Statute not yet in force, which, according to Law no. 14/2003, cannot produce legal effects before approval by the Bucharest Tribunal. At the time of the Congress, this draft had neither been submitted to the court nor approved or published in the Official Gazette, leaving the 2025 statute as the only enforceable document.
  • The Extraordinary Congress was illegitimately convened, based on non-statutory valid decisions of the National Extraordinary Council on June 19, 2026, lacking justification for an exceptional situation or urgency, required for deviation from regular meetings.
  • The “automatic” exclusion violates statutory disciplinary procedures, the right to defense, and an enforceable court order for suspension. The Ilfov Tribunal had already suspended similar measures by Civil Sentence no. 1016/2026 on June 18, 2026.
  • Procedural irregularities affected the Congress: inadequate communication of delegate lists, incomplete quorum verification, missing constitution minutes and vote counts, biased presentation of voting points, and a ballot lacking rejection and abstention options.

Consequently, they seek court acknowledgement of the void nature of the contested resolutions and related acts.

June 18, 2026: Ilfov Tribunal Suspends PNL National Bureau Decisions

Further legal actions have led to the suspension of several decisions by the PNL’s National Bureau, overseen by President Ilie Bolojan.

This includes actions against liberal parliamentarians for voting contrary to party lines regarding a potential Veștea Government.

The same 16 anti-Bolojan parliamentarians later sought the Ilfov Tribunal’s intervention to suspend the calls for the National Extraordinary Council and the PNL Extraordinary Congress.
