CCR to Review Constitutionality of SAFE Ordinance on Thursday

The Constitutional Court of Romania (CCR) has scheduled a review of the constitutionality of the law approving Emergency Ordinance No. 21/2026, which amends Ordinance No. 62/2005. This ordinance concerns the implementation measures for the Council Regulation (EU) 2025/1106, established on May 27, 2025, to create the “Action for the Security of Europe” (SAFE) instrument.

This legal challenge was initiated by over 50 deputies from the political parties AUR, SOS România, and PACE, along with some unaffiliated deputies.

In their submission to the CCR, the complainants argued that the ordinance extended beyond the scope of the SAFE program, affecting legislation in other areas such as the National Recovery and Resilience Plan (PNRR).

The government has defended the ordinance, emphasizing its necessity for swiftly executing investments in the defense industry through the SAFE program and safeguarding the assets of companies deemed strategic.

“The Emergency Ordinance was reintroduced on the agenda of the Government meeting on May 8, 2026, after being adopted in the May 4 session. This was to address the negative opinion issued by the Legislative Council. The purpose of the ordinance is to adjust the legal framework to facilitate rapid investments in the defense sector, capitalizing on the opportunities provided by the SAFE program, and to protect assets of companies declared strategic by Government resolution,” the government communicated at the time.

In a separate session on June 10, the CCR will also address a request to resolve a constitutional legal conflict between Parliament and the Government. This request was filed by the President of the Chamber of Deputies, Sorin Grindeanu, also concerning the SAFE ordinance.

The “Action for the Security of Europe” (SAFE) instrument aims to strengthen Europe’s defense industry by allocating €16.68 billion to Romania for purchasing military or dual-use equipment and developing dual-use infrastructure.

Limba română nu este izvor de extraneitate a legii.
